For each visitor to our Web page, our Web server automatically recognizes no information regarding the domain or e-mail address. We collect the e-mail address of those who communicate with us via e-mail, aggregate information on what pages consumers access or visit, user specific information on what pages consumers access or visit and information volunteered by the consumer, such as survey information and/or site registrations.

The information we collect is used for internal review and is then discarded, used to improve the content of our Web page, used to customize the content and/or layout of our page for individual consumer and used by us to contact consumers for marketing purposes.

If you do not want to receive e-mail from us in the future, please let us know by sending an e-mail, calling or writing, and telling us that you do not want to receive e-mail from our company.

The Grass Emporium will NEVER send you an email requesting personal information (such as credit card information).  If you receive such an email requesting such information, PLEASE DO NOT RESPOND.

Terms of Use Statement

You understand and agree that the owners of this site shall not be liable for any direct, indirect, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, data or other intangible losses (even if the owners of this site have been advised of the possibility of such damages), resulting from the use or the inability to use the product(s) and or service(s) or any misuse of the product(s) and or service(s) in a manner not in accordance with their intended use.

Guarantee and Return Policy

We reserve the right to limit quantities and correct typographical errors.

We guarantee that all plants will arrive to you alive and in good condition for growing. During the first year, if your plants fail to grow in your garden, we will replace them. Customers must pay shipping and handling on plants replaced under our guarantee and the replacement plants must be sent to the original shipping address. We must have the item number and description of the plants or item. This guarantee is limited to perennial plants that are suited for growing in your USDA Zone.

The Grass Emporium may not be held responsible for customer misuse.  Special order items and sale items are not covered by our guarantee and, in the case of merchandise, can't be returned.  Sorry, we cannot take returns on plant materials.

All orders are processed assuming they will be shipped complete. However, back orders do occur; these items will be shipped as they become available. 
Orders placed during the current growing season will be filled the same growing season.  In the event that we are out of a particular size, we reserve the right to fill the order with a size that is of greater or equal value.  We will accept advanced orders (preorders) for next year after November 1 and before the following March 1.  Preorders will be charged when placed and shipped on the dates noted below.  However, if the dates below are not acceptable to the customer, preorders will be shipped when requested but will not be eligible for our guarantee.

We reserve the right to correct calculation and charge errors and to verify funds with your bank before shipping. There is a $35 service charge for all returned checks.

We accept Visa, Mastercard, Discover and American Express credit and associated debit cards.  Charges will appear on your credit card statement as being from Dove Creek Gardens, Inc.

Online order security is important to us. Shopping at The Grass Emporium is safe and secure. However, you can fax your credit or debit card information, for online orders, if you feel uncomfortable providing personal information online. You can mail a check or money order, denominated in U.S. dollars and drawn on a U.S. bank, with your order, if you do not want to use or do not have a credit or debit card. Checks will be deposited upon receipt. Sorry, C.O.D. orders are not offered.

The Grass Emporium ships orders via US Postal Service (70 lbs. maximum/order). Large orders ship via motor carrier - email us for a quote. We can only ship to one address per order. Sorry, we do not ship to Alaska or Hawaii.  Orders are FOB our nursery and are NOT insured.  The Grass Emporium assumes NO responsibility for lost or damaged orders/packages.  Shipping insurance is available for an additional fee during checkout.

Plants are shipped March through November (shipping season). Gift certificates ship year around.  During shipping season, we ship Priority Mail packages on Monday, Tuesday, and Wednesday to ensure that your plants arrive prior to the weekend.  Express packages are shipped to arrive the next day (no Saturday or Sunday deliveries).

For pre-orders placed after November 1 and early orders for the current growing season, we ship orders to reach you at the correct planting time.
Our earliest shipping dates are:
Zone 9+             beginning Mar 1,
Zone 8               beginning Mar 18,
Zones 7&6         beginning April 15,
Zone 5               beginning May 1,
and Zones 4&3   beginning May 15.

When our nursery temperatures exceed 95F, we will delay your shipment until the temperature drops back below 95F.

Orders of $100.00 or more (excluding shipping and handling) for delivery within a 30 mile radius of our nursery will be delivered free.
